Coaching agreement
These are the standard terms for one-to-one online coaching provided by Hilton Coaching to clients worldwide. Your individual offer, coach, price and start date will be confirmed before payment.
1. Agreement and eligibility
This agreement is between Hilton Coaching (we, us or our) and the person purchasing coaching (you or the client). You accept these terms by signing or electronically accepting this agreement and purchasing coaching. Coaching is currently available only to clients aged 18 years or older. You confirm that the information you provide is accurate and that you have legal capacity to enter this agreement.
2. Your coaching service
Your selected package will identify whether Hilton Im or Billy Dix is your primary coach. The service may include a customised training program, general nutrition guidance, WhatsApp support, form feedback, monthly private video check-ins and reasonable program adjustments. Your written offer and onboarding information form part of this agreement.
Hilton's direct coaching package provides coaching and communication directly with Hilton. Billy's essential package is delivered directly by Billy to Hilton Coaching's service standards. Unless agreed otherwise in writing, replies are provided within 24 hours on normal coaching days. Response times may be longer during emergencies, illness, public holidays or circumstances outside our reasonable control.
3. Fees, billing and cancellation
Coaching is billed monthly in United States dollars through our payment provider. The current standard prices are US$250 per month for coaching with Hilton and US$175 per month for coaching with Billy, unless a different price is confirmed in your written offer. You authorise the agreed recurring charge until cancellation.
You may cancel at any time by giving us clear written notice before your next billing date. Cancellation stops future renewals and coaching continues until the end of the current paid period. Payments already made are not automatically refundable, except where required by applicable consumer protection law or allowed under our separate Refund Policy.
4. Your responsibilities
- Provide complete and honest information about your goals, experience, health, injuries, medications and relevant limitations.
- Follow the agreed program responsibly and ask questions when instructions are unclear.
- Use safe equipment, appropriate technique and a suitable training environment.
- Stop an exercise and seek appropriate help if you experience pain, dizziness, illness or unusual symptoms.
- Complete check-ins honestly and communicate problems early enough for us to respond.
- Attend agreed calls or provide reasonable notice when you need to reschedule.
- Treat both coaches respectfully and use coaching communication appropriately.
5. Health, safety and medical clearance
Exercise carries inherent risks, including soreness, strains and other injury. You remain responsible for deciding whether you are physically able to participate. We may ask you to obtain clearance from a doctor or another qualified health professional before starting or continuing coaching. We may pause or decline coaching when it would be unsafe or outside our professional scope.
You must not disregard professional medical advice because of anything communicated through coaching. In an emergency, contact local emergency services rather than waiting for a coaching response.
6. Scope of nutrition guidance
Nutrition support is general fitness and lifestyle guidance for goals such as muscle gain, fat loss or body recomposition. It is not medical nutrition therapy, diagnosis or treatment, and it does not replace advice from a doctor or accredited practising dietitian. You must disclose relevant allergies, eating disorders, medical conditions and prescribed dietary requirements. We may refer you to an appropriately qualified professional.
7. Results and progress
We will provide coaching with due care and skill, but individual results depend on factors outside our control, including adherence, health, sleep, stress, training environment and genetics. No specific amount of weight loss, muscle gain, strength or timeframe is guaranteed. Any testimonials and transformations show individual experiences and are not promises of identical results.
8. Communication, form checks and check-ins
Coaching may be delivered through WhatsApp, Google Meet, WhatsApp video, email, training software or another agreed platform. Form-check videos must show only what is reasonably necessary for technique feedback. Monthly calls should be scheduled within the applicable paid period and do not accumulate indefinitely when missed. We may retain relevant coaching communications and videos as business records in accordance with our Privacy Policy.
9. Privacy, photos and testimonials
We handle personal and health information as described in our Privacy Policy. Providing coaching information does not give us permission to publish it. We will obtain separate, express permission before using your name, image, testimonial, progress photo or transformation for marketing. You may decline marketing consent without affecting your coaching.
10. Programs and intellectual property
Your program and coaching materials are licensed to you for your personal use during and after coaching. You must not sell, publish, reproduce, distribute or provide them to other people without our written permission. You retain ownership of content you create, including your photos and videos, subject only to the permissions you expressly give us.
11. Pausing or ending coaching
We may pause, refuse or end coaching where there is non-payment, abuse, harassment, dishonesty, unsafe conduct, repeated failure to communicate, a serious conflict of interest, or a matter outside our competence. Where reasonable, we will explain the issue and provide an opportunity to address it. Any refund or remaining service will be determined fairly, consistently with this agreement and applicable consumer protection law.
12. Liability and consumer rights
Nothing in this agreement excludes, restricts or modifies any consumer right, statutory guarantee or remedy that cannot lawfully be excluded in your country or region. To the extent permitted by applicable law, neither party is responsible for indirect or consequential loss that was not reasonably foreseeable. You remain responsible for losses caused by inaccurate information, reckless conduct or use of the program contrary to clear instructions.
13. Changes and disputes
We may update these standard terms for future billing periods by giving reasonable notice. A material change will not retrospectively alter a period already paid for without your agreement. If a concern arises, contact us first so we can try to resolve it promptly and fairly. Because Hilton Coaching operates from Queensland, this agreement is governed by the laws of Queensland, Australia. However, this choice of law does not remove any mandatory consumer rights or legal protections that apply to you in your country or region.
